Terms and Conditions
These terms govern the use of ViewPulse as a Twitch level system, dashboard, bot and panel for streamers.

2. Scope
These terms apply to the use of ViewPulse through the website, dashboard, Twitch bot, Twitch panel and connected interfaces.
ViewPulse is primarily aimed at streamers and community managers. Viewers use ViewPulse within the respective Twitch channel without automatically becoming a contractual partner of a paid ViewPulse offer.
Different user terms apply only if ViewPulse has expressly agreed to them.
3. Service description
ViewPulse provides functions for Twitch streamers, especially a level and progress system with XP, levels, ranks, watchtime, streaks, dashboard functions, bot functions, blocklists and a Twitch panel.
The specific scope depends on the active plan, technical availability and currently offered functions. Roadmap, patchnotes and announced functions are planning information and do not guarantee implementation, timing or final scope.
4. Registration and Twitch connection
A Twitch login is required for certain functions. The user must be authorized to manage the respective Twitch channel or set up ViewPulse for that channel.
Additional Twitch permissions may be required for bot and panel functions. If required permissions are revoked or not granted, individual functions may be limited or unavailable.
Users are responsible for keeping credentials, tokens and logged-in devices secure and not sharing them with unauthorized third parties.
5. Free and paid plans
ViewPulse may offer free and paid plans. The respective scope, terms, prices and payment conditions are shown on the website or during the order process.
Paid functions are provided only after the contract has been concluded and required payment has been successfully confirmed, unless otherwise agreed.
ViewPulse may change, limit or discontinue free functions where necessary for operation, security, development or economic viability of the service.
6. Conclusion of contracts for paid offers
Presentation of paid plans is not a legally binding offer but an invitation to order. A contract is concluded when the user completes the order process and ViewPulse accepts the order or unlocks paid access.
Before a paid order is completed, the essential contract data such as service, term, price and payment method will be shown.
7. Prices, payment and invoices
The prices stated at the time of ordering apply. Unless stated otherwise, prices include applicable statutory VAT.
Available payment methods are shown during the order process. Payments may be processed by external payment providers. Their own terms and privacy information may additionally apply.
If payment is not completed successfully or is reversed later, ViewPulse may restrict or suspend access to paid functions until the issue is clarified.
8. Term and termination
Paid plans may be offered with monthly, yearly or otherwise stated terms. Unless stated otherwise, a paid plan can be terminated at the end of the respective term.
The right to extraordinary termination for good cause remains unaffected. Good cause may include serious misuse, payment arrears, security violations or substantial breaches of these terms.
Once ViewPulse offers paid continuous obligations directly through the website to consumers, a legally required cancellation option will be provided on the website.
9. Withdrawal right for consumers
Consumers may have a statutory right of withdrawal for distance contracts. Details, deadlines and exceptions will be provided during the order process and in a separate withdrawal notice once paid consumer offers can be concluded through ViewPulse.
Businesses do not have a statutory consumer withdrawal right.
10. User obligations
Users agree to use ViewPulse lawfully and appropriately.
- No manipulation of XP, levels, watchtime, streaks or statistics
- No circumvention of protection mechanisms, bans or limits
- No use for spam, harassment, fraud or other abuse
- No disclosure of credentials, tokens or confidential system data
- Compliance with Twitch rules and third-party rights
In case of violations, ViewPulse may restrict functions, suspend accounts, correct data or terminate contracts extraordinarily.
11. Twitch, third parties and platform dependency
ViewPulse technically depends on Twitch and other technical services. Changes to Twitch, Twitch APIs, Twitch rules, OAuth permissions, chat functions, extension approvals or platform limits may require functions to be changed, restricted or temporarily unavailable.
ViewPulse does not guarantee that Twitch permanently provides or approves specific status indicators, bot labels, panel approvals or API functions.
12. Availability, maintenance and updates
ViewPulse strives for stable operation. Uninterrupted availability at all times is not guaranteed. Maintenance, updates, security measures, server issues, database issues or third-party disruptions may cause limitations.
ViewPulse may perform updates, improve functions, fix bugs and make technical changes as long as the essential contractual purpose is not unreasonably impaired.
13. Content, data and responsibility
Streamers remain responsible for their Twitch channel, community, content and lawful use of ViewPulse in their channel. ViewPulse provides technical functions but is not responsible for content, statements or actions of streamers, moderators or viewers.
ViewPulse may process, store and evaluate technical data where necessary for operation, security, abuse prevention, statistics, billing or further development. Details are provided in the Privacy Policy.
14. Suspension and deletion
ViewPulse may temporarily suspend accounts or individual functions if there are concrete indications of abuse, security risks, payment problems or breaches of these terms.
Users may request deletion of their account unless legal retention duties or legitimate interests prevent this. Technical residual data may remain in backups or logs for a limited time.
15. Liability
ViewPulse has unlimited liability for intent, gross negligence and injury to life, body or health.
In case of slightly negligent breach of essential contractual obligations, ViewPulse is liable only for typical, foreseeable damage. Essential contractual obligations are obligations whose fulfillment enables proper performance of the contract and on whose compliance users regularly rely.
Otherwise, liability is excluded as far as legally permitted.
16. Changes to these terms
ViewPulse may change these terms where objective reasons exist, especially technical changes, new functions, legal changes, payment model changes or adaptations to platform requirements.
Users will be informed appropriately about material changes. If a user does not agree to changed terms, further use of paid functions may be restricted or ended.
17. Consumer dispute resolution
ViewPulse is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless a legal obligation exists.
18. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
If a provision of these terms is or becomes invalid, the validity of the remaining provisions remains unaffected.
